Terms of Service

These terms govern your use of UpFollow.ai ("UpFollow", "we", "us"), the AI follow-up agent for Gmail built by the team behind MailTracker. By creating an account you agree to them.
1. The service
UpFollow connects to your Gmail account, detects emails you sent that are still waiting on a reply, drafts follow-ups in your voice, and — once you approve them — sends them from your own Gmail account in the original thread. UpFollow requires a Google account and a working Gmail connection to function.
2. Your account
You must provide accurate information and keep your Google account secure. You are responsible for activity under your account. You must be at least 16 and able to enter a contract.
3. Trial, pricing & cancellation
- New accounts get a 7-day free trial with full access.
- After the trial, UpFollow costs $29/month (or $290/year), billed by Stripe.
- You can cancel anytime from the app; you keep access until the end of the paid period. Fees already paid are non-refundable except where the law requires otherwise.
- We may change prices with at least 30 days' notice; changes apply from your next billing cycle.
4. You approve every send
UpFollow drafts; you decide. Emails leave your account only after your approval, and they are sent from your own Gmail address, under your name. You are the sender of record and responsible for the content of every follow-up you approve, including its compliance with applicable email and marketing laws.
5. Acceptable use
You agree not to use UpFollow to send spam, unsolicited bulk email, or unlawful, deceptive or harmful content; not to violate Gmail's or Google's terms; and not to probe, disrupt or reverse-engineer the service. We may suspend accounts that put deliverability, other users, or the service at risk.
6. AI-generated content
Drafts are generated by AI from your real threads. They are usually good — and sometimes wrong. Review every draft before approving it. We are not liable for the consequences of content you chose to send.
7. Your data
Your email belongs to you. How we access and protect it is described in our Privacy Policy, including our compliance with the Google API Services User Data Policy (Limited Use). You can disconnect Gmail or delete your account at any time.
8. Intellectual property
We own the service, its design and its software. You own your email content and the follow-ups sent from your account. You grant us only the limited rights needed to operate the service for you.
9. Warranty & liability
The service is provided "as is". We do not guarantee that every unanswered email will be detected, that drafts will be error-free, or that the service will be uninterrupted. To the maximum extent permitted by law, our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages (including lost deals or lost profits).
10. Termination
You can stop using UpFollow and delete your account at any time. We may suspend or terminate accounts that breach these terms, with notice where practicable.
11. Changes, law & contact
We may update these terms; material changes will be announced in the app or by email, and continued use means acceptance. These terms are governed by French law, and disputes belong to the competent courts of Paris, subject to any mandatory consumer protections of your country of residence. Questions: [email protected].
